{"id":12384,"date":"2025-07-17T11:30:20","date_gmt":"2025-07-17T15:30:20","guid":{"rendered":"https:\/\/www.mtl2424.ca\/?p=12384"},"modified":"2025-07-17T11:34:17","modified_gmt":"2025-07-17T15:34:17","slug":"new-noise-bylaws-its-time-to-act","status":"publish","type":"post","link":"https:\/\/www.mtl2424.ca\/en\/new-noise-bylaws-its-time-to-act\/","title":{"rendered":"New Noise Bylaws: It&#8217;s Time to Act!"},"content":{"rendered":"\n<p>Le Plateau-Mont-Royal and Ville-Marie plan to officially adopt a new bylaw as early as Fall 2025.<br>Performance venues, nightclubs, cultural spaces \u2014 your favourite spots are being targeted!<\/p>\n\n\n\n<p>The current draft bylaw (finally) establishes clear decibel limits. But several measures risk further weakening cultural nightlife venues.<\/p>\n\n\n\n<p>The new bylaw carries over two major flaws from the previous one:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A single complaint is enough to trigger police intervention, and<\/li>\n\n\n\n<li>Noise is deemed \u201cexcessive\u201d based on the subjective judgment of the responding officer.<br>Moreover, the SPVM could now shut down a performance on the spot (Article 29).<\/li>\n<\/ul>\n\n\n\n<p>These are exactly the kinds of measures that directly led to the closure of Divan Orange and put La Tulipe at risk.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">Other problematic measures include:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>A significant increase in fines<\/strong> (Article 34):\n<ul class=\"wp-block-list\">\n<li><em>Old bylaw:<\/em> $1,500 to $12,000<\/li>\n\n\n\n<li><em>New bylaw:<\/em> <strong>Minimum $10,000 for a first offense<\/strong> \u2014 a <strong>566% increase<\/strong>!<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Mandatory sound monitoring<\/strong> (Article 33):\n<ul class=\"wp-block-list\">\n<li>The City or SPVM could require the <strong>purchase of a sound monitoring system<\/strong><\/li>\n\n\n\n<li><strong>Continuous recording for 12 months<\/strong><\/li>\n\n\n\n<li>And could request access to the data <strong>at any time<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">Here\u2019s what we propose:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Eliminate immediate police intervention<\/li>\n\n\n\n<li>Handle complaints differently:\n<ul class=\"wp-block-list\">\n<li>Through a specialized and proactive department<\/li>\n\n\n\n<li>Using a clear, fair, and culturally appropriate process<\/li>\n\n\n\n<li>With <strong>systematic mediation<\/strong> before any penalties<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>No police action based on a single isolated complaint<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>This works elsewhere in the world \u2014 so why not in Montr\u00e9al?<\/p>\n\n\n\n<p>The City has launched an online public consultation. Now is the time to speak up!<br>Submit your comments, criticisms, and recommendations using the City of Montr\u00e9al\u2019s <a href=\"https:\/\/forms.office.com\/Pages\/ResponsePage.aspx?id=3NIVn1OHg0-qwqWCiNOkvDGcrM6PFvpNjRu6TDu_1rJURVNQQkpZMkFXRTZKUzNXNDJVT0JRTTcxOC4u\"><strong>online feedback form<\/strong><\/a> (deadline: July 25, 2025).<\/p>\n\n\n\n<p>Montr\u00e9al calls itself a cultural city.
